Welcome to 4Rent. These Terms of Service ("Terms") govern your use of the 4Rent platform, website, and services. By creating an account or using any part of the platform, you agree to these Terms. Please read them carefully.
1. Acceptance of Terms
By creating an account or using the 4Rent platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the platform. If you are using the platform on behalf of a business, you represent that you have authority to bind that entity.
2. Description of Service
4Rent is a subscription-based property management platform that provides landlords with tools for portfolio management, tenant management, lease generation, rent collection, maintenance tracking, expense tracking, and AI-assisted legal guidance. Tenants may access a portal to view lease information, submit maintenance requests, and make rent payments. Some features require a paid subscription.
3. Account Registration
Landlords must register with a valid email address and accurate business information. Tenants are invited by their landlord and must register with the email address on file. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must be at least 18 years old to use the platform.
4. Subscription and Billing
Landlord subscriptions are billed monthly or annually through Stripe. Subscription plans and pricing are displayed on the Pricing page. Payments are processed by Stripe and are subject to Stripe's terms. Subscriptions automatically renew unless cancelled. A 10-day money-back guarantee applies to new subscriptions as described on the Pricing page. The platform administrator account is exempt from subscription charges.
5. Rent Payments
Tenants may pay rent through the platform via Stripe. 4Rent facilitates the payment process but is not a party to the lease agreement between landlord and tenant. Payment processing is subject to Stripe's terms and fees. Late fees, grace periods, and rent terms are set by the landlord in the lease agreement and are not determined by 4Rent.
6. Lease Generation and Legal Guidance
4Rent provides AI-assisted lease generation and legal guidance tools. These tools are for informational purposes only and do not constitute legal advice. Lease templates are generated based on state-specific requirements but may not cover all local ordinances or specific circumstances. You are strongly encouraged to have lease agreements reviewed by a qualified attorney before execution. 4Rent is not liable for legal issues arising from AI-generated lease content.
7. User Responsibilities
Landlords are responsible for the accuracy of property, tenant, and lease information entered into the platform. You agree to use the platform in compliance with all applicable federal, state, and local laws, including fair housing laws, tenant privacy laws, and landlord-tenant regulations. You may not use the platform to discriminate against any tenant or applicant.
8. Acceptable Use
You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to access another user's data without authorization; (c) upload malware or harmful code; (d) interfere with platform operations; (e) use automated tools to scrape or extract data; (f) impersonate another person or entity; or (g) use the platform to harass or harm tenants, landlords, or vendors.
9. Intellectual Property
The 4Rent platform, including its design, features, content, and branding, is owned by 4Rent and protected by intellectual property laws. Lease templates, AI-generated content, and reports are provided for your use but remain subject to platform terms. You retain ownership of the data you input (property records, tenant information, lease details).
10. Third-Party Integrations
4Rent integrates with Google (Calendar, Docs, Gmail), Microsoft Outlook, Stripe, and WhatsApp. You are responsible for reviewing and complying with the terms of these third-party services. 4Rent is not liable for disruptions or issues caused by third-party service changes or outages. Connecting a third-party service grants 4Rent access to that service only for platform functionality.
11. Data and Privacy
Your use of the platform is also governed by our Privacy Policy. By using 4Rent, you consent to the data practices described in our Privacy Policy. Landlords acknowledge that tenant information shared through the platform (lease documents, rent reminders, maintenance updates) is necessary for platform functionality.
12. Limitation of Liability
4Rent is provided "as is" without warranties of any kind. To the maximum extent permitted by law, 4Rent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising from your use of or inability to use the platform. 4Rent's total liability shall not exceed the amount you paid in the preceding 12 months.
13. Indemnification
You agree to indemnify and hold 4Rent harmless from claims, damages, and expenses arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of applicable laws or third-party rights; (d) content or information you submit, including lease agreements and tenant communications; or (e) disputes with your tenants.
14. Termination
You may cancel your subscription at any time. 4Rent may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in conduct harmful to the platform or its users. Upon termination, you may request an export of your data for 30 days, after which it may be permanently deleted subject to legal retention requirements.
15. Changes to Terms
We may update these Terms of Service from time to time. We will notify users of significant changes via email or in-app notification. The "Last Updated" date below reflects the most recent revision. Continued use of the platform after changes constitutes acceptance of the updated terms.
16. Governing Law
These Terms are governed by the laws of the United States and the state in which 4Rent operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the appropriate courts of that jurisdiction.
